Parking while vending

Hi

I park my car in loading/unloading bays or on yellows (within the set hours) while I service my vending machines.

Just got a ticket in Manchester for this, cos the guy ddn't 'see' me unloading. He could see note in window, and stock in the back though.

I appealed but they want a copy of invoice/receipt for the goods unloaded. I obviously don't have one because its my own stock?

Do councils not consider loading vending machines as unloading goods?, what have other people experienced?

Just write back saying you don't have one, they will reject your appeal (Quite normal) . You then ask for a tribunal, at the tribunal the adjudicator will ask you to describe the incident in detail ,you simply tell him how you were dropping off a new machine to replace a faulty one. It is large and bulky. You entered premises, unscrewed machine and returned to find a ticket on your car/van, 5 minutes walk to site and sign in, 5 minutes to replace machine, 5 minutes back to car/van.

You were there for 15 minutes, definitely not 20 minutes. 8-)

Never paid a ticket yet and have got off most of my friends tickets.

Make sure you get all your responses in on time.

To say you were delivering, with a sign in your window is not enough you need more evidence. The council in there fairness seem to have indicated they will reconsider if you re- applied and enclosing with proof of delivery. Make out a set of delivery notes to the effect that you were delivering the machine refill items. I've always signed them myself and submitted the documents with my appeal. You must do this before you go to any tribunal and without your appeal will fail. I've even gone back to the site to get the owners signature and fotos of the item being delivered.

Take it from me, It happens all the time here in london, I have had 20-30 successful appeals and won 4 out of five tribunals that I have attended. You do need your evidence otherwise you will fail. I've had a few lucky escapes on technicalities, so read the notices carefully and make sure dates, road names etc. are all correct and also if recieved by post are within the 14 day time limit for notification.

There are some instances where there is no defence, yellow & double yellow lines are ok for loading, but watch out for yellow stripes on the pavement. double yellow stripes on the pavement is of course no loading at any time. In the London boroughs thete is no defence for PCNs recieved for pavement parking.

Hi Pete,

I have never provided any 'evidence, just gave my side of the story to the adjudicator and it worked fine.

Most of the time no matter what you submit in your first appeal it is automatically rejected.

A loading notice in the window was what the council have suggested to me previously, but we just park and take no notice.

councils as well have a parking number to call if you are loading and going to be over 20 minutes and on double yellows , you give them your registration and they allow you to park whilst working if no parking is available/ impractical .

They try and keep that quiet though.

Hi Matt,

Nice to know about the paking no. to phone if you are over by 20 mins. I always have a windsreen notice, parking attendants do tend to ignore them sown my way. I've provided the evidence with the first appeal, with 90% sucess, on the other occasions the council, after seeing my evidence, pulled out before the actual hearing (three times). It's good to get it sorted before the tribunal stage, as attending the hearings is time consuming, especially at the rate that I accumilate PCNs!

Yes agreed Pete , probably easier to send off evidence. I do love meeting with the councils representatives though to give them some grief!

I have had a ticket sent through with pictures of me loading taken by the parking warden. When they asked for evidence I told them to look at the photos they had supplied. This was rejected , remarkably when it went to tribunal it was thrown out.
