Hi guys - its just busy at this time of year. I haven't forgotten about Joe. Can't believe he didn't go into liquidation like he said he would. Well maybe not so surprised but disappointed it was just another blatant lie.
I'll start looking into doing small claims thing against him.

Well I've started and saved a small claim. And I've emailed Joe (and cc-d his accountants William Giles in Sittingbourne) to give him one last opportunity to clear the debt before it get escalated by court fees. Anyone done a small claim before? Is it worth it,for £67.50? Will I get anywhere, against a limited company?

Hi Alex ,

It will cause jo a lot of problems, as you cannot just start a ltd company up take money and go. He has certain duties to follow or it is fraud. Also if a ltd compNy deliberately takes money out of a ltd company before bankruptcy as a dividend directors are liable and May have to repay , if he has taken cash through appropriate channels .His accountants will advise him of this , but to submit a return is a few hundred quid as well.

Small claims is very cheap and if you get certain benefits it is free
