Hi,
Has anyone ever used the small claims court system.
I had a tower vandalised and all stock and money stolen last week. It is in a hotel and the only guests were employees of one company, who were working at the local Sainsburys. The police are investigating, but as yet, they dont have a clue as to which of the 20 odd sub contractors it was that did it. Witnesses have said that they saw 4 of them damaging it, but dont know who they were. These people also trashed a room and their employer, Red Recruitment, is apparrently paying the hotel for the damage.
If the Police cant find a suspect, I am considering taking the employer, or the individual, if found, to the small claims court, so any advice is welcome.

Hi paul,
Find out if the emploeyer pays for the hotel first. as if they do they are admitting liability. Small claims is pretty simple to do and it costs about 20 quid to issue a summons to pay. If they dont pay or admit liability then I think its about £100 for it to be heard in court.

I will see what the Police do first. I am at the site today, so will find out if Red Recruitment have, or are paying. Do you normally claim the cost of a new machine and stock at value, or stock sold. ( This machine was sold out according to the staff, before it was broken into.)

It costs about £35 pounds,you first have to send a letter of intent and give them notice of 15 days,you have to then fill out three copys of the same paperwork state what happened in your own words.
take the competed paperwork back to the court and once your paid the fee they stamp it ,give you a copy the court a copy and the company your sueing the other copy.
In most cases they settle before it gets to the court stage and if you win your get back your fee.
Bill them for the machine and the stock at £1.00 per can.
If you have a crime no put it in your letter of intent it helps them decide to pay up.
Over the last 20 years ive had countless machines nicked but know it you don'nt do nothing the same builders do it again on the next pub,the police are useless they didnt eithen want to finger print my last machine smashed to crap and didn't want to change the guy because it turned out he was a police informent.

Put in a clain for £160 worth of turnover, £500 for the machine and never look back. If these thugs had no bothher trashing your machine then don't you worry about getting a few quid extra for loss of turnover , diesel, your time etc. £660 would just about make the hassle worth it.

You dont need go to court to get it stamped, file a money claim online lot less hassle,cheaper & quicker. £25 up to £300 & this doesnt have to include your costs or charges that you can add including charges for letters & interest.

Still waiting for the Police to talk to the supervisor, before I can decide which way to go. If the Police are not able to prosecute, I will try talking to the employer, before I involve the court.
